2.3. Spanking and disciplining children As it is true that spanking cannot teach children what to do and what not to do. Because every human being wants to do something according to his will. These are the following reasons why children should never be spanked: 1. Spanking has serious harmful side effects that parents have no way of seeing, because such effects do not show up until later. 2. Spanking is no more effective than other methods of correction and control, and it is therefore unnecessary to subject children to the risk of the harmful side effects. 3. Spanking contradicts the ideal of nonviolence in the family and society . There can be various assumptions that spanking proves to be effective: 1. It controls the behaviour of the …show more content…
Austin’s particular theory of law is often called the “command theory of law” because the concept of command lies at its core: law is the command of the sovereign, backed by a threat of sanction in the event of non-compliance. He distinguished positive law from positive morality which is devoid any legal sanction. In his own words, “the existence of law is one thing, its merit and demerit is another...A law which actually exists, is a law, though we happen to dislike it or though it may vary from the text by which we regulate our approbation or disapprobation …show more content…
He distinguished science of jurisprudence from ethics. Austin thus made his system of law logical, coercive and enforceable as a distinct from law as it ought to be. For him, command was “the key to the science of jurisprudence. Child spanking can also be considered on the basis of “command theory of law”. Spanking is enforceable by law. Law is the command of the sovereign. If you disobey the law the in-charge can be punish as he want to. On Austin 's view, a rule R is legally valid i.e., is a law in a society S if and only if R is commanded by the sovereign in S and is backed up with the threat of a sanction. Whatever the sovereign command is law, and law prescribes to do certain things and not to do others. The demand of personal obedience in Austin 's theory means that the span of the life of the legal system determines the period of existence of the laws of the system and hence also of the legal system itself. Austin came out with the solution of "tacit" command for the problem of continuance of old laws. Law is command given by superior to
Is Spanking A Problem Solver? Today's day and age parents try to steer clear of spanking their children and try a more modern approach on parenting trying to give a positive discipline. But does that solve everything? In this article “No Spanking, No Time-Out, No Problem” Alan Kazdin uses several elements throughout this article.
overview In 1854 the Texas legislature authorized a commission to codify the existing laws in Texas; and in 1856 the Texas Penal Code was established. Prior to 1856 Texas was governed mostly by common law; it was not until 1895 that the Texas Penal code was revised. In 1974 the Texas Penal code went through another revision, this time more extensive than the previous revisions, and mostly based on the American law institute penal code model. The main goal of the revision was too Clarify and consolidate the fundamental law of crimes, and to modernize and simplify the penal code for the rural, less populated areas of Texas, to reasonably grade offenses based on the severity of the crimes; as well as to ensure that the punishment for committing
My feelings regarding spankings are inappropriate because it models aggressive behavior in young children. 8. Spankings should be administered with care. 9. Corporal punishment is the use of physical force causing pain, but not wounds, as a means of discipline; such as spanking, shaking, slapping hands and etc.
In the article “No Spanking, No Time-out, No Problems”, Olga Khazan uses many rhetorical strategies to support and persuade her audience. That traditional punishment methods of parents will not change a child’s/children’s unruly behavior overall, but positive reinforcement will increase the chances of better behavior not only now, but in the future as well. “Positive reinforcement is the presentation of a pleasurable consequence following a behavior” (Craighead). This twist to traditional discipline teaches children to work towards a resolution instead of teaching them to lean toward violence. “For example, the way that parents discipline their children is how children discipline their peers” (Khazan).
The laws, however also help advance Equality to discover and learn more about his world. The commands in place are to stop individuality among men and create a easier environment to control, however these laws also help puch Equality to learn and grow more which allows him to produce his inventions and discover the Unspeakable
Many oppose spanking as a form of discipline because psychologists, therapist, counselors plus many others have researched the behavioral, psychological and emotional effects. Some have found that it can lead to depression, delinquency etc. I do not think that spankings cause negative affects because of studies and personal experience. Certain circumstance in the household along with spanking may lead to negative outcomes.
Whether spanking is helpful or harmful to children continues to be the source of debate among both researchers and the public. Many argue that spanking your children helps inforce good behavior and is a form of discipline for the bad. Although this maybe the reason why parents spank their own children many say spanking is a form of abuse. They say spanking your child can cause mental health problems and can cause negative outcomes.
For example, it makes kids more violent and impairs prosocial behavior (206). Some people even go as far as calling spanking inhumane (2016). Also, many states have made it illegal to spank kids at school (206). However, most people still spank their children and would scoff at the idea of ever making this act illegal. Unlike the United States, some countries do not find spanking tolerable.
Spanking can be effective when a child is not listening to a parent. If a child isn’t following proper rules and disregarding their parents’ statement, then a spanking can enforce a form of respect that the child has to follow (Jasmine, 2015). It can be an awakening to reality as the child could now think of how their actions are deviant. Parents that don’t resolve to spanking as the first and only method of discipline is essential for both the parents and the child. I believe a parent should always try to enforce rules by talking and showing examples of how deviant actions are frowned upon.
Many people think that the reason for this is easily described as “if you hold the reins too tight, the horse will buck.” Over punishing a child can be a bad thing, it will make the child want to retaliate more so than if one were to cut a little slack. However, under punishing a child can be bad as well, not teaching a child right from wrong can majorly increase the odds of the child doing the wrong thing. Reasons that parents give for spanking their children are to make children listen better, and to encourage better behavior, especially to put a stop to children's aggressive behaviors. Research shows, however, that spanking, or indeed any form of physical punishment, tends to have the opposite effect.
Studies have shown that spanking increases aggression 2. Spanking has been linked to lower IQ 3. Physical punishment is associated with increased mental illness C. Thesis Statement: Even though most parents use
Is Kelsen’s Pure Theory of Law pure? In his famous article “On the Pure Theory of Law,” Hans Kelsen discusses his pure theory of law. He argues that the only pure form of law theory is the theory of positive law, which he calls “legal positivism”. Kelsen presents legal positivism to be the only consistent form of jurisprudence because this theory considers the law in its positive form and it separates law from any other social disciplines such as sociology, anthropology, politics and ethics.
Growing up my parents ran a daycare in(at) our house so I was always surrounded by children (the good and the bad). My parents were the type who had no problem enforcing physical punishments such as spanking, the flick of the hand, a pop on the mouth, etc. All these punishments are within the definition of acceptable punishment as stated by Oklahoma law (qtd. ---). They practiced this on me, my siblings, and the daycare kids (with parental consent).
Law personal statement main As a child, looking up to law-enforcers such as police officer’s has made me believe that Law is the backbone of our society. Without it, everyday life would not be tolerable. My passion for law developed when I stepped into the Supreme Court and watched a court case in the Old Bailey.
Law is present in our daily life and in everything we do. We cannot think a second without law. Whatever we can see around us everything is connected with the law. Sometimes we can see it and sometimes we cannot see but feel it. Law is not just a thing to obey for yourself but making a peaceful society.
