In May of 1787, 55 delegates came to Philadelphia to have a Constitutional Convention. They had this meeting so they could make the U.S. Constitution. They wanted to make one because the articles of the Confederation were not working. They wanted to make a Constitution that would benefit the U.S. The Constitution also guarded against tyranny in 4 different ways, Federalism, Separation of powers, checks and balances and big State little State, compromise. So, we know by now there’s the House of Representatives and the Senate in the legislative branch, the amount of members in each are based off a compromise between the Virginia plan and the New Jersey Plan. The Virginia Plan called for the votes in congress to be based on population, while New Jersey called for the votes to be equal amount states. The House of Representatives is based of the population idea of the Virginia Plan, consisting of no more then 435 members, each state has proportional representation based on population. The Senate, however, is based of the New Jersey Plan, each state having two senators, equal representation among all the states. So how is it that a document made made over 200 years ago has managed to overcome the ruling of tyranny? Tyranny is the harsh and absolute power in the hands of an individual. The Constitution guarded against tyranny in several ways: federalism, the separation of powers, the checks and balances system, and large v. small states.
Federalism is when the government splits into two, state and federal. The government is separated so that the not one person(s) gets too much power over the United states. James Madison quotes, “In the compound republic of America, the power surrendered by the people is first divided between two distinct governments (state and federal).” For example, the Federal government can regulate trade, conduct foreign relations, provide an army and navy, declare war, print and coin money, set up post offices, make immigration law. State government can set up local governments, hold elections, establish schools, pass marriage and divorce laws, and regulate in-state businesses.
At that time congress had no real power because of the Articles of Confederation the US had adopted in 1777. Congress had to rely on contributions from the existing states. Needing and knowing that a change was needed the delegates from different states met to form a new plan of action. One that would give congress more power, equal representation for each state, form a new structure of government and the way it would run to benefit the United States of America. The senate has many exclusive powers that are not granted to the House such as consenting to treaties as a precondition to ratification and/or confirming appointments of cabinet members, secretaries, federal judges and other federal executive officials and including military officers.
