The Trail of tears was when Andrew Jackson forced the Cherokee tribe to give up all of their land east of the mississippi river. In 1829, Andrew Jackson signed the Indian removal policy, to make it so the Indians would get with drawn from the east of the Mississippi River and relocate them to the west of the Mississippi River. The tribes that were affected were the Cherokee, Chickasaw, Choctaw, Creek, and Seminole. These tribes had to leave their homeland and get relocated to the west of the Mississippi River against their will, so that slave owners could use their land for slavery. Andrew Jackson illegally forced the Cherokee tribe off of their land because the Supreme court ruled that the state of Mississippi couldn't make treaties or do anything that was on Cherokee land. The Supreme court could have ruled the Indian removal act unconstitutional.
The Trail of tears was very harsh on the native americans and made them lose over 4,000 Cherokee members. The treaty of new echota made the Cherokee tribe move the west of the Mississippi River and would pay them money not exceeding 5 million dollars. Congress was ruled by the Jacksonians and they were democratic and the anti-Jacksonians were republican, so every time Andrew Jackson wanted to pass a law it usually got passed because Congress was on his side. “Jackson refused to believe that Native American tribes were sovereign and thus viewed Indian treaties as an absurdity. Andrew Jackson, John Marshall, and The Trail of Tears There have been many dark times in our History as Americans. Among them is the Trail of Tears,brought upon by Andrew Jackson, which exiled the Indians from the American south and resulted in the death of thousands on the way to Oklahoma. Before this trying time there was speculation within the supreme court whether to treat the Native tribes as a sovereign foreign nation or as a dependent entity within the United States. I will discuss how these decisions came to be, the reactions to said decisions, and the aftermath of these rulings which inevitably leads to the Trail of Tears.
The trail of tears was a tretrous journey that the native Americans took. Because the Americans would promise land, then take it back. First off it was approximately one thousand miles. The five different tribes were the Cherokee, Choctaw, Seminole, and finally the Creek. They traveled from deep in the south to present day Oklahoma.

I decided to research about The Trail of Tears Removal Act when my mom bought me a book about “100 events that changed the world” to give me some ideas for the trail of tears. Each day I would read about five to ten stories right before I went to bed. I finally landed on the Trail of Tears and remembered in fifth grade learning about the horrible journey. Before doing any research on the Trail of Tears I assumed that the Americans were being greedy and wanted more land. But no, they found gold and pushed away the Native Americans to the Indian Territory which began their journey.

The Trail of Tears began during the 1830’s. The reason the Trail of Tears took place was because of the enforcement of the Treaty of New Echota. The Treaty of New Echota was an agreement that was signed under the provisions of the Indian Removal Act. The Trail of Tears was a big event that happened.
This was because gold was found on Cherokee land in Georgia, and American citizens needed more places to live, expanding our territories further south. However, someone got in the way: a man named Samuel Worcester allied himself with the Cherokee Indians and sued the state of Georgia in 1832. This led to the Worcester v. Georgia Supreme Court case. Chief Justice John Marshall ruled in favor of the Indians, stopping the removal, but Jackson didn’t listen, disobeying the Judge’s orders. For someone or something to be unconstitutional, it must first be judged by the Supreme Court.

When people think of the first people on America, they may think of Christopher Columbus or the European colonists, when actually the first people here were the Indians. The Trail of Tears was a forced relocation of the Native Americans from their homelands. Indian lands were held hostage by the states and the federal government. Therefore this caused them to have to agree to removal so that they could preserve their identity as tribes. In The Trail of Tears you will know that there was unfairness, prejudice and what impact it had on the lives of the Native Americans during that time and also the lasting effects.
Andrew Jackson disobeyed a direct order from the Supreme Court, which it means he was above the law. I really wonder how Americans tolerated him, at that time, he was cruel to the Indian common man. Because of him, the Native Americans have the worst end of the Trail of Tears. They are the ones who are forced out of their traditional homes and sent away on a journey of pain and death. Those who had fallen ill, most of the time died, and those who had the will to move on were able to make it to the end and start new lives.
