Crime Description This paper will analyze the murder of Vanessa Pham by Julio Miguel Blanco-Garcia. Around 3:30 in the afternoon on June 27, 2010, as Vanessa Pham was leaving a nail salon in Fairfax Plaza Shopping Center when Julio Blanco-Garcia approached her. Blanco-Garcia, high on PCP and carrying his infant daughter, told Pham that he was having a medical emergency and asked her to drive him to the hospital. Vanessa agreed and allowed the two into her car. Not long into the trip to the ER, Vanessa took a wrong turn which roused the suspicions of her drug addled passenger. Convinced that Vanessa intended to turn him in to the police or otherwise wrong him, Garcia pulled a butcher knife out of his backpack and attacked Vanessa. In a retributive justice system, the state is tasked with bringing Blanco-Garcia to justice. The state will accuse Blanco-Garcia of murdering Vanessa Pham and hold an adversarial trial to determine whether he is guilty of the crime or not. An appointed defense attorney (DA) will represent Blanco-Garcia at trial. Due process demands that the defendant is afforded legal representation to argue matters of law on his behalf as well as to protect the defendant’s other due process rights. Likewise, the state will also be represented by a legal agent, the commonwealth attorney (CA). The two attorneys will present their case before a judge. During the trial the CA will introduce Blanco-Garcia’s confession in which he admits killing Vanessa Pham as she drove him to the hospital. The DA will offer a counter argument that his client attacked Pham because he believed that she posed a danger to him. Furthermore, that the PCP his client took earlier that day decreased his mental capability. The CA will reason that the amount of times the defendant stabbed the victim indicates an intent to kill. An Atlanta mother went on a rampage, massacring her family by stabbing four of her children and her husband to death, but one child who survived, described the chilling moments the murders took place. Nine-year-old Diana Romero watched as her mother, Isabel Martinez, picked up a knife from the kitchen and slashed her family members one by one as they slept, KSDK reports. The woman took the lives of her husband, 33-year-old Martin Romero, 10-year-old Isabela Martinez, seven-year-old Dacota Romero, four-year-old Dillan Romero, and two-year-old Axel Romero, before she picked up the phone and called 911 to report they were dead.
On the night of January 20th, 1998 in Escondido, California, the lives of the family of 12 year old Stephanie Crowe were turned upside down. Stephanie’s body was discovered lifeless on her bedroom floor by her parents and grandmother. Stephanie had been stabbed 9 times, and there was no sign of forced entry into the house. The young girl’s window was unlocked that night but there was a screen in place and there was no evidence showing there was an entry through the window. The sliding glass door in the parent’s, Steve and Cheryl Crowe, room was also unlocked but they claimed they would’ve heard if someone had came through the door because of the blinds on the door.

In a criminal case, first the jury is selected, followed by a preliminary hearing where it is decided if there is enough evidence for the case to be brought up in the court of law, then an arraignment occurs where the defendant pleads guilty, not guilty, or no contest. After this, the plea hearing begins where the defendant can make an agreement with the prosecutor to make a plea bargain, which is pleading guilty to a less serious crime and giving up the right to a speedy public trial to avoid risk conviction of greater penalty for a more serious crime, after which the trail starts. During the trial, opening statements are given, evidence is presented, examination and cross-examination of witnesses take place, followed by closing statements. Once the trial is finished the judge instructs the jury and they leave to deliberate. The jury returns with their verdict only if the decision is unanimous, if it isn’t the judge orders a mistrial where the trial is called off completely or a new jury is selected.

Plea bargains are negotiations between the prosecutor and the criminal defendant. In this negotiation, the criminal defendant consents to pleading guilty. When the criminal defendant takes the guilty plea, he or she is able receive reductions in their charges or sentences. There are pros and cons of plea bargains, but these bargains can be doing more harm than good. Plea bargaining is a simple process but can have long term repercussions.

This case is about the arrest and sentencing of John Burke who had shot and killed Joseph Ronan. Twenty-five year old John Burke agreed to meet with 22 year old Joseph Ronan at Ronans home, in Reading, Massachusetts on Monday, August 15, 2011 around 1pm, with the intent of purchasing Percocet pills. (Boston.com, 2013) However, shortly after entering Ronans home, Burke opened fire (News, 2011), and after shooting Joseph Ronan several times, with the belief that Ronan was involved in a robbery at Burkes apartment in April 2011 (Boston.com, 2013), fled the home.

New details emerge in the case of illegal alien Adrian Espinosa-Flores who was charged last week with involuntary manslaughter while driving under the influence and leaving the scene of a fatal crash. According to a newly released affidavit, illegal alien Espinosa- Flores had twice the legal alcohol limit when slammed his Ford F-250 into the back of Johnson County Master Deputy Brandon Collins during a routine traffic stop on September 11, 2016. While Officer Collins sat in his patrol car, he was hit so forcefully that his car became wedged between the SUV he pulled over and Espinosa-Flores’ truck. The incredible impact between his patrol car and Espinosa-Flores’ truck engulfed both vehicles in flames as Collins remained pinned between two cars tragically resulting in his death.

While his interview, Lopez explained how he selected his victims, “I walked among the markets searching for a girl with a certain look on her face, a look of innocence and beauty.” He could lure little girls away from a crowded place like markets with the promise of little trinkets such as hand mirrors.
