Are older people entitled to protection from employment discrimination as a class? How might a law protecting older people from discrimination work?
According to Wikipedia, Discrimination is treating people differently. Employment discrimination is treating one person better than another because of their age, gender, race, religion or other protected class status.
Age discrimination refers to the actions taken to deny or limit opportunities to people on the basis of age. These are usually actions taken as a result of one 's ageist beliefs and attitudes. Age discrimination occurs on both a personal and institutional level.
However, an older person may be told that he or she is too old to engage in certain physical activities, like an informal game of basketball between friends and family. A younger person may be told they are too young to get a job or help move the dining room table. On an institutional level, there are policies and regulations in place that limit opportunities to people of certain ages and deny them to all others. The law, for instance, requires that all young person must be at least 16 years old in order to obtain a driver 's license in the United States. There are also government regulations that determine when a worker may retire. Currently, in the US, a worker must be between 65 and 67 years old (depending upon his or her birth year) before becoming eligible for Social Security retirement benefits, but some company pension plans begin benefits
The world sat by in silence, as crimes against humanity were being committed. “Every man for themselves,” is what the world responded, to those who were enslaved, tortured, and discriminated against. The book, “Night” by Elie Wiesel, recalls the details of the torture he endured. Elie lost his family, friends, faith, and will to live, in a matter of 2 years. Imagine how others, who were in the same position as Elie, felt.
Ageism is a massive issue that is a part of our everyday lives. This form of discrimination can occur to any individual in any age range. Ageism is usually mentioned when expressing the prejudice older adults experience. The article, “What is Ageism?,” states that, “researchers have suggested that stereotypes about older people often relate to how younger people expect them to behave.” (Have You Experienced Ageism?2022)

The act shields employees from both their workmates and employers and the company at large. Title VII civil act address a number of issues including sexual orientation-related discrimination, age discrimination, gender discrimination, racial/tribal or place of origin discrimination, and religious discrimination (McKay, 2017). The preceding period before enactment of the Title VII civil act was plagued by widespread discrimination in all spheres of life.
The new ruling by President Obama that employers must disclose pay data also this law extends the period in which a pay discrimination suit can be filed. This law is believed to help the Equal Employment Opportunity Commission and Labor Department to better do their job and enforce the equal pay laws. Recently discussion of pay within the office is becoming more common and less taboo. Another way that this law is thought to work is also to help companies self-correct without the help of the government are by a lawsuit. The EEOC reports that women are only paid 79 cents on the dollars that the typical man does the gap is even wider for women of color.
The EEOC as defined by my resource is, “The Equal Employment Opportunity Commission that enforces federal laws prohibiting workplace discrimination.” This agency was created back in 1964 when the Civil Rights Act was relevant. The goal was to initially protect minorities so they have just a much of an opportunity to work as everyone else. Today they protect more than just African Americans, but everyone! What they do today is interpret the law to reflect the freedom and rights that everyone is entitled to.
Although we are more educated now about older adults this has not changed our perception of the elderly. Ageism continues to exist. Ageism is the prejudice or discrimination against an individual based on their age; this is usually experienced by older adults. Negative stereotypes are widely spread and accepted by our society and culture. In the United States older adults are more likely to be discriminated because society encourages older adults to be marginalized, institutionalized and restrained from responsibilities, control, and power.
Family and Medical Leave Act The Family and Medical Leave Act established in 1993 is for working individuals to take unpaid leave for up to twelve weeks in a one-year time period (“The Family,” n.d.). The act grants insurance, wage and job security upon return for specific medical and family obligations. Such circumstances include the delivery of a child, adoption of a child, care for an immediate family member with a severe medical condition, a serious health condition themselves or care for an injured military member. To be eligible for the Family and Medical Leave Act (FMLA) an employee must be employed for a minimum of twelve months, 1,250 hours and their workplace employ at least fifty people within 75 miles (“The Family,” n.d.).
The three most important laws that regulate discrimination regarding employment are Title VII which is the Civil Rights Act of 1964, Age Discrimination & Employment Act, and The American with Disability Act. The Civil Rights Act of 1964 protects people from being discriminated against because of their race, religion, color, sex, and national origin (Aiken, Salmon, & Hanges, 2013). The Age Discrimination & Employment Act protects individuals from being discriminated against people who are over the age of 40 and older. The goal is to promote the employment of older workers based on their abilities not their age (Harlan, 1985). The Americans with Disability Act protects people who have physical or mental disabilities (Meyerowitz, 2017).

We could change this problem by allowing individuals to do what they want, and if they are not capable we should guide them into another activity. this issue should be discussed, because we judge people by their age and evaluate what they are capable of doing. In this essay, I will be describing how anti- discriminatory practice is promoted in health and social care. Letting clients using health and social care services and allowing them to have their own say and make their own decisions and social care professional respecting that promote anti-discriminatory practice. This helps make individuals feel empowered. National initiatives are made to make sure individuals using health and social care services are treated fairly e.g. someone could be treating a disabled person the way you would treat a normal person and just because they are disabled doesn't mean they must be treated differently and they are useless they should be treated with dignity and respect. There are difference strategies that organizations can use to cope up with age discrimination in the workplace. Implementing strategies that place older people in positions best suited to their ability stereotyping them. Finding the ways to make technology friendlier to older people as this can enhance the workplace experience for an older population.
According to Stone (2013), discrimination is when another person is differentiate from another groups based on their sex, race, disability, marital and parental status. In the anti-discrimination legislation, it is known as making a group in advantaged and the other are in disadvantaged. Employment discrimination happens when employees and job applicants were discriminated because of their weaknesses, their family medical history, women that are pregnant, or the connection with a certain individual.
